Terms & Conditions

These Terms & Conditions apply to all purchases made through our online store ("Website", "we", "us" or "our").

By placing an order through our Website, you acknowledge that you have read and accepted these Terms & Conditions.

1. Products and Product Descriptions

We make reasonable efforts to describe and photograph our products accurately.

Product descriptions may include information concerning:

  • product type;

  • precious-metal content;

  • weight;

  • fineness;

  • dimensions;

  • year of issue;

  • mint or manufacturer;

  • condition;

  • grade, where expressly stated;

  • packaging;

  • accessories; and

  • other characteristics specifically stated in the individual product listing.

The characteristics expressly stated in the individual product listing form part of the contractual product description.

Photographs are intended to provide an accurate representation of the product. However, colours may vary slightly depending on lighting, photography, display settings and the device used to view the Website.

Where an individual photograph is provided and identified as depicting the actual item being sold, that photograph takes precedence over generic or representative product images.

2. Pre-Owned, Vintage and Numismatic Products

Unless expressly stated otherwise, products offered by us may be pre-owned, previously circulated, vintage or collectible items.

Such products may naturally exhibit characteristics associated with their age, previous ownership, manufacture, storage or circulation.

Depending on the individual product and its stated condition, such characteristics may include:

  • minor scratches;

  • handling marks;

  • toning;

  • patina;

  • milk spots;

  • oxidation;

  • surface marks;

  • minor edge marks;

  • variations in colour;

  • signs of previous storage or handling; or

  • other characteristics consistent with the stated condition of the item.

Such characteristics do not constitute a defect where they are consistent with the product description and the condition disclosed before purchase.

Where a particular defect, imperfection or condition is material to the product, we will disclose it in the relevant product description where required by applicable law.

3. Customer Responsibility When Selecting a Product

Customers are responsible for reviewing the individual product listing carefully before placing an order.

This includes, where applicable, checking:

  • product type;

  • denomination;

  • metal;

  • weight;

  • fineness;

  • year;

  • quantity;

  • condition;

  • size;

  • variant;

  • packaging; and

  • any other product characteristics stated in the listing.

A customer's subsequent change of mind, investment strategy, financial circumstances or personal preference does not constitute a product defect.

Likewise, a customer's decision to purchase a particular product does not create any guarantee that the product will increase in market value or retain its purchase price.

4. Investment and Market Risk

Our products may be affected by fluctuations in precious-metal prices, currency exchange rates, collector demand and other market conditions.

We do not provide investment, financial, tax or legal advice.

Any purchase is made at the customer's own discretion and risk with respect to future market value.

A decrease in the market price, resale value, collector value or investment value of a product after purchase does not constitute a defect or failure to perform the contract.

We do not guarantee that a product will appreciate in value, retain its purchase price or be resalable at any particular price.

The customer remains solely responsible for their own purchasing and investment decisions.

5. Prices and Market Fluctuations

Prices displayed on the Website are the prices applicable at the time of purchase, unless otherwise stated.

Subsequent changes in the market price of precious metals or collectible products do not result in a right to a retrospective price adjustment.

Likewise, an increase in the market value of a product after purchase does not result in any additional payment being due to the seller.

6. Orders and Contract Formation

Products displayed on our Website constitute an invitation to customers to submit an order.

By submitting an order, the customer makes a binding offer to purchase the selected products.

The purchase contract is concluded when we accept the customer's order, for example by expressly confirming the order or by dispatching the goods, unless otherwise stated during the ordering process.

We reserve the right to reject an order where there is a legitimate reason, including obvious pricing or listing errors, suspected fraud, inability to obtain the product, or other circumstances permitted by applicable law.

If an order cannot be fulfilled after payment has been received, any amount already paid for the affected order will be refunded where required by law.

7. Order Errors

Customers should carefully review their order before completing the purchase.

If a customer has selected the wrong product, quantity, variant, year, denomination or other option, the customer should contact us immediately.

We will attempt to accommodate cancellation requests where the order has not yet been processed or dispatched. However, we cannot guarantee cancellation once an order has been accepted, processed or dispatched.

Nothing in this section limits any statutory right the customer may have, including any applicable statutory right of withdrawal.

8. Statutory Right of Withdrawal

Where a consumer has a statutory right of withdrawal under German law, that right remains unaffected by these Terms & Conditions.

The statutory withdrawal right and the applicable withdrawal period are explained separately in our Withdrawal Policy.

Certain contracts may be excluded from the statutory right of withdrawal under Section 312g(2) BGB. This can include certain goods whose price depends on fluctuations in financial markets over which the trader has no control and which may occur within the withdrawal period.

Whether this statutory exception applies depends on the particular product and the circumstances of the transaction. It is therefore not intended that this clause automatically excludes withdrawal rights for every product sold through our Website.

9. No Voluntary Return Policy

Except where a statutory withdrawal, cancellation, rescission or other legal right applies, we do not provide a general voluntary return or exchange programme.

A customer may not return a correctly supplied product merely because they have subsequently changed their mind, no longer want the product, consider the purchase financially undesirable, or disagree with the subsequent market price.

Nothing in this clause limits mandatory statutory consumer rights.

10. Authenticity and Contractual Characteristics

We will supply products corresponding to the contractual description provided in the relevant product listing.

Where authenticity, precious-metal content, weight, fineness, manufacturer, mint, year or another specific characteristic is expressly stated as part of the product description, the product must conform to that contractual description.

If a product materially fails to conform to the agreed description, the customer's statutory rights remain unaffected.

11. Defective or Incorrect Products

If a product is defective, materially different from the contractual description, or otherwise does not conform to the contract, the customer should contact us promptly after discovering the issue.

Where a statutory defect exists, the customer has the rights provided by applicable German law.

Depending on the circumstances, these rights may include repair or replacement and, where the statutory requirements are met, a reduction of the purchase price, rescission of the contract or damages.

We do not voluntarily limit or exclude statutory consumer rights.

A refund or other remedy for a defective product will be handled in accordance with the applicable statutory requirements.

12. Minor Variations and Natural Characteristics

Minor variations that are inherent to the manufacture, age, circulation, storage or nature of a product do not constitute a defect where they are consistent with the product description.

For example, differences in toning, surface appearance, patina or photographic colour representation may occur in collectible and precious-metal products.

This does not affect the customer's statutory rights where an actual contractual defect exists.

13. Shipping and Delivery

We will dispatch orders using the shipping method selected or offered during checkout.

Delivery times displayed on the Website are estimates unless expressly stated as binding.

The statutory rules concerning the transfer of risk apply.

For consumer purchases, the risk of accidental loss or accidental deterioration generally remains with the seller until the goods are delivered to the consumer, subject to statutory exceptions.

If a consumer independently appoints a carrier that was not previously offered or designated by us, the statutory rules concerning transfer of risk may apply.

Nothing in these Terms & Conditions is intended to transfer statutory consumer shipping risk to the consumer contrary to German law.

14. Lost, Delayed or Damaged Shipments

If a shipment appears to be lost, delayed or damaged, the customer should contact us as soon as reasonably possible.

We will cooperate with the shipping provider and take commercially reasonable steps to investigate the shipment.

Where the statutory risk remains with us, we will comply with our legal obligations.

Where the risk has legally transferred to the customer, we are not responsible for the resulting loss except where we are otherwise legally responsible.

Customers should not dispose of damaged packaging or shipping materials before the matter has been investigated, as these may be required for a carrier claim.

15. Delivery Addresses

The customer is responsible for providing a complete and accurate delivery address.

If a delivery cannot be completed because the customer provided an incorrect or incomplete address, failed to accept delivery, or otherwise caused the failed delivery, we reserve the right to charge reasonable additional delivery costs to the extent permitted by applicable law.

This does not affect any statutory consumer rights.

16. Liability

We are liable without limitation:

  1. for damage resulting from injury to life, body or health caused by an intentional or negligent breach of duty by us or our legal representatives or agents;

  2. for damage caused intentionally or through gross negligence;

  3. in cases of mandatory statutory liability; and

  4. where liability cannot legally be excluded or limited.

In cases of ordinary negligence, our liability is limited to the foreseeable damage that is typical for the contract where we have breached a material contractual obligation.

A "material contractual obligation" means an obligation whose fulfilment is essential for the proper performance of the contract and on whose fulfilment the customer may ordinarily rely.

The above limitations do not apply where mandatory law provides otherwise.

17. No Liability for Market Losses

We are not responsible for losses arising solely from changes in:

  • precious-metal prices;

  • currency exchange rates;

  • collector demand;

  • resale prices;

  • market liquidity;

  • auction prices; or

  • other market conditions,

provided that the product supplied complied with the contract.

The customer's purchase decision is independent and no representation is made that the product will increase in value or maintain its purchase price.

18. No Guarantee of Future Value

Unless expressly stated otherwise in writing, we do not provide any guarantee concerning the future value, investment performance or resale price of any product.

Historical prices, market information or other information appearing on the Website are provided for general informational purposes and do not constitute a promise or guarantee of future performance.

19. Payment

Payment must be completed using one of the payment methods made available during checkout.

We reserve the right to restrict available payment methods for individual orders where legally permissible.

The goods remain subject to the applicable statutory rules concerning ownership and payment.

20. Retention of Title

Until full payment has been received, the goods remain our property to the extent permitted by applicable law.

21. Force Majeure and Events Beyond Our Reasonable Control

We are not responsible for delays caused by circumstances beyond our reasonable control, including, where applicable:

  • natural disasters;

  • war;

  • civil unrest;

  • strikes;

  • governmental measures;

  • significant disruption to transportation networks;

  • major technical failures;

  • cyber incidents;

  • widespread payment-system failures; or

  • other unforeseeable events beyond our reasonable control.

Mandatory statutory rights remain unaffected.

22. Applicable Law

German law applies to the contractual relationship, subject to mandatory consumer-protection provisions applicable in the country where the consumer has their habitual residence.

The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

23. Consumer Dispute Resolution

We are not willing and are not obliged to participate in dispute resolution proceedings before a consumer arbitration or conciliation body, unless a statutory obligation to participate applies in an individual case.

Where applicable, statutory information obligations concerning consumer dispute resolution remain unaffected.

24. Severability

If any provision of these Terms & Conditions is or becomes invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The mandatory statutory provisions applicable to the relevant transaction shall apply instead of any invalid provision.

25. Statutory Consumer Rights

Nothing in these Terms & Conditions is intended to exclude or restrict any consumer right that cannot legally be excluded or restricted under applicable law.

Where these Terms & Conditions conflict with mandatory statutory provisions, the mandatory statutory provisions shall prevail.
